For the purposes of the defendant`s determination of the access element in a copyright infringement proceeding, access is normally defined as copyability. When sellers are preparing to sell a package and there are questions about whether they have lawful access, I often advise clients to have the title reviewed by a lawyer so that we can use that legal advice to make it clear that there is legal access. Surveys can also help clear up confusion. A right of way is a specific easement that gives access to a parcel of land through one or more private properties. It is often described in deeds as a route of entry, exit and return of a property through the land of one or more other properties to a publicly accessible road. DRM systems are the result of the combination of licensing agreements that determine what you can and can`t do with the job and technology protections (TPMs) that technically prevent you from doing things that aren`t allowed in the license. The most important thing to remember about TPMs is that trying to circumvent or “circumvent” them is illegal. It doesn`t matter if what you`re trying to do with DRM-protected works is legal (or if you think it`s legal), circumventing protection is mostly illegal because DRM technology itself is protected as a form of quasi-copyright. If you need to break the DRM to use the copyrighted work the way you want, it`s safe to say that you don`t have permission to use it. This is especially difficult if you have a copyright exception, such as quotes or news reports, but you cannot use the work because it is protected by TPMs. For example, you can review a movie or make a video report, but the footage you want to use is protected by technology. In these cases, the law provides for a procedure that should allow you to use the content, but it is so difficult that no one has followed it so far. For the commercial reuse of a copyrighted work, permission is granted in the form of a license and usually requires payment of a user fee. Licensing is often carried out by organisations called “collecting societies”. Collecting societies license copyrighted material on behalf of rightholders and also collect royalties for the use of works. Alternatively, there are intermediary services that have licenses that allow users to reuse works for both commercial and non-commercial purposes. However, you should always make sure that you read the terms and conditions of these services so that you know exactly what you can and cannot do with the material you intend to use.
