757.69(1)(p)1. 1. Preside over any hearing deciding whether or not to issue a divorce decree if both parties declare that the marriage has been irretrievably broken down and that all essential issues, including but not limited to division of property or estate, custody, placement, child support, spousal support and family maintenance have been resolved; or if one of the parties does not participate in the divorce proceedings. A Circuit Court Commissioner may render judgment in any action over which he or she presides under this Subdivision, unless the judgment alters an agreement between the parties on material matters. If the circuit court commissioner does not approve an agreement between the parties on important matters, the request is confirmed to the court for trial. 757.69 The issuance of a search warrant is not an exercise of “judicial power” as used in subsection VII(2). Instead, the issuance of a valid search warrant requires that the person have the legal authority to issue the warrant, be neutral and distant, and that the warrant be issued only if there is evidence of probable cause. Article 1 lit. b does not impermissibly interfere with “the jurisdiction of the courts under Article VII, Section 2” and is constitutional.
